Terms of Service

The agreement between you and OgaHost (operated by Zorn Technologies LLC) governing your use of our hosting, server and domain services.

Effective date: 1 August 2026

1. Introduction

Welcome to OgaHost. OgaHost is a web hosting brand operated by Zorn Technologies LLC ("OgaHost", "we", "us", or "our"), a company registered in the United States. These Terms of Service ("Terms") govern your access to and use of our Shared Hosting, Business Hosting, Cloud VPS, Managed VPS and Domain registration services (collectively, the "Services").

By registering for, accessing, or using any Service, you agree to be bound by these Terms and all policies referenced herein, including our Acceptable Use Policy and Privacy Policy. If you do not agree with these Terms, you must not use the Services and should cancel your account immediately.

2. Acceptance of Terms

Users and customers of Services provided by OgaHost must accept the terms and conditions of business set out below.

  • A. Client's use of the Service is at the Client's own risk.
  • B. Client takes full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on OgaHost's infrastructure.
  • C. Client is responsible for all use of its own account(s) and keeping all passwords safe and confidential, and setting file protections correctly.
  • D. If a password is lost, stolen, or otherwise compromised, OgaHost will suspend access or change Client account access immediately following notification by the Client.
  • E. OgaHost is not responsible for any usage or charges prior to the notification and account alteration.
  • F. OgaHost makes email as safe as it possibly can, but no computer network can ever be considered completely safe from intrusion. Knowing this, and that all email may pass through many computer networks, it should not be considered a secure communication unless encrypted, and even then it is only as secure as the encryption method used.

3. Account & Responsibilities

To use the Services you must provide accurate and complete registration information, including your legal name, postal address and telephone number. Providing false or incomplete contact details, including name, postal address and telephone number, is a ground for suspension or termination.

You are responsible for:

  • Maintaining the confidentiality of your account credentials and notifying us immediately of any unauthorized use.
  • All actions that occur under your account, whether authorized by you or not.
  • Setting correct file and directory permissions on your hosting space.
  • Keeping independent, off-site backups of your websites and data at all times.

4. Domain Names

The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority; ICANN in the case of .COM/.NET/.ORG and the appropriate registry for other TLDs. You shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name.

Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.

We shall not release any domain to another provider unless full payment for that domain has been received by us. All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our website and shall be due and payable in advance of our service provision.

5. Domain Disputes

We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute.

6. Payment, Charges & Suspension

Without prejudice to our other rights and remedies under this Agreement, if any sum payable is not paid on or before the due date, we shall be entitled forthwith to suspend the provision of Services to you.

All charges payable by you for the Services shall be in accordance with the scale of charges and rates published from time to time by us on our website and shall be due and payable in advance of our service provision. We will not add charges to customers using either VISA or Mastercard card schemes; the final price will be the same regardless of payment method.

7. Indemnification

You shall indemnify us and keep us indemnified and hold us harmless from and against any breach by you of these terms of business and any claim brought against us by a third party resulting from the provision of Services by us to you and your use of the Services.

8. Termination by OgaHost

  • If you fail to pay any sums due to us as they become due, we may suspend the Services and/or terminate this Agreement forthwith without notice to you.
  • If you break any of these terms and conditions and you fail to correct the breach within seven (7) days following written notice from us specifying the breach, we may terminate this Agreement forthwith.
  • If you go into insolvent liquidation or suffer the appointment of an administrator or administrative receiver or enter into a voluntary arrangement with your creditors, we shall be entitled to terminate this Agreement forthwith.

On termination of this Agreement or suspension of the Services we shall be entitled immediately to block your website and to remove all data located on it. We shall be entitled to delete all such data but we may, at our discretion, hold such data for such period as we may decide to allow you to collect it at your expense, subject to payment in full of any amounts outstanding and payable to us.

9. Affiliates

  1. You can promote us on your website, YouTube channel or social media profile.
  2. You cannot use an affiliate link for your own usage.
  3. You should not engage in any black-hat SEO or spam link-building techniques in order to generate more referrals for OgaHost.
  4. You are required to disclose the affiliate relationship with OgaHost on your website.
  5. You agree not to violate any applicable law.

10. Data Security

We use advanced encryption, access controls, and monitoring systems to protect your information from unauthorized access, misuse, or loss. Regular audits and updates are performed to ensure compliance with international data protection standards.

11. Refund Policy

At OgaHost, we strive to provide the best possible service. If you are dissatisfied with any aspect of our service, please contact our support team, who will work diligently to resolve the issue. If the issue cannot be resolved to your satisfaction, you may request a refund within 14 days from the time of purchase. Please note that no refunds will be issued beyond the 14-day period.

Non-Refundable Services

Refunds are not available for the following:

  • Cloud VPS – non-refundable under any circumstances.
  • Managed VPS – non-refundable under any circumstances.
  • Domain Names – including but not limited to .COM, .NET, .ORG and other TLDs; registration and transfer fees are non-refundable.
  • SSL Certificates and other third-party products and services provided through external providers.

Promotional Offers

For services purchased under a promotion (with or without a promo code), the refund policy is as follows:

  • A refund will be issued for the amount actually paid by the customer, excluding any discounts.
  • If a free domain was claimed as part of a promotional hosting package, the regular domain registration fee will be deducted from the refundable amount, as domain registration fees are non-refundable.

Payments via Cryptocurrency

If payment is made using cryptocurrencies, any eligible refund will be issued as account credit only, which can be used for future purchases or renewals. Cryptocurrency payments are not refundable to the original payment method.

Policy Violations

No refunds will be issued if your hosting or other services are terminated due to violations of our Acceptable Use Policy or these Terms, except as explicitly provided in those policies. This does not affect your statutory rights.

Account Credit

Any credit added to your account is non-refundable and must be used for future purchases or renewals.

Overpayment

If you have sent funds in excess of the amount owed, the excess amount will be added as account credit and cannot be refunded.

Account Balance

Your account balance cannot be withdrawn and cannot be refunded under any circumstances. Account credit has no cash value and will not be paid out to you or transferred to any third party.

Renewal Payment

All renewal payments are final and non-refundable once processed. It is your responsibility to ensure that you wish to continue with the service before the renewal date. No refunds will be issued for renewals that are processed automatically or manually, except where required by applicable law.

12. Service Level Agreement

Hosting Services

If your service drops below 99.9% uptime in any given month you will be credited with one free month. This must be claimed within 7 days of our monitoring dropping below this level.

Any planned maintenance work is exempt from this guarantee and will be ignored. This 99.9% uptime commitment also applies to our Cloud VPS and Managed VPS services, each of which carries the same monthly credit entitlement where the measured uptime falls below 99.9%. Uptime level is calculated by our status page and monitors only.

13. Delivery of Services

Immediately upon successful payment you will receive an automated receipt from our systems. Please print and retain a copy of this for future reference. Your unique customer username will be on this receipt and should be used for any enquiries to OgaHost.

We aim to deliver all goods as soon as signup is complete. If we are unable to adhere to this you will be informed via email. Payment will be deducted when services are delivered.

All orders are delivered electronically via email. If you have any questions about your order please contact us at support@ogahost.com. Our trading hours are 365 days a year, 24/7, and we normally respond within 15 minutes of receiving your enquiry.

The services available on this site are subject to both export and/or import restrictions. Please check regulations in the country you are in to see if these products are allowed for import into your country.

14. Hosting Services

These Terms of Service and Acceptable Use Policy ("Terms and Policies") are an essential part of your relationship with OgaHost. By using your OgaHost account, you agree to all of the Terms and Policies set out in this document.

The Service is provided to authorized persons or organizations (referred to in this document as "Subscriber" or "you"). Any use of the Service is subject to any restrictions listed below. By using the Service, you agree to be bound by all of these Terms and Policies. If you do not agree to be bound by these Terms and Policies, you must cancel your account immediately and may not thereafter use or attempt to use the Service.

15. General Terms and Policies

  • Coverage – If you are an individual Subscriber, these Terms and Policies apply to all persons who gain access through your account. If you are a commercial Subscriber, these Terms and Policies apply to all your employees, agents and/or customers. In either instance, a violation of these Terms and Policies by anyone using your account will be treated as a violation by you.
  • Prices and Charges – OgaHost provides the use of cPanel and domain control panels to you free of charge, but if through misuse or abuse on your part we incur any charges, we reserve the right to pass these charges on to you.
  • Term – The Service is provided to you for as long as you wish to use it, however we withhold the right to terminate the service if you use it in a way that violates the terms of use.
  • Backups – OgaHost carries out regular backups for disaster recovery purposes. These backups are strictly for our own use in case of a server failure. However, you can also ask for a backup to be restored to your files. This is not meant as a replacement for keeping your own backups and we are not responsible for loss of data. Always confirm that you have your own backups. Again, we are not responsible for loss of data.

16. Acceptable Use Policy

You agree to use the Services lawfully and in accordance with all applicable laws and regulations. You may not use the Services to:

  • Violate any statute, law, court order, tariff, regulation or treaty, including those relating to intellectual property, communications, privacy, criminal and international law.
  • Host websites dedicated to pornography. Legal adult content is permitted only where it is not the primary focus of your website.
  • Send unsolicited bulk email ("spam"). A clean-up fee applies if our server IP addresses appear on a blacklist as a result of spam from your account.
  • Use your hosting as a file, image or backup storage service. All files must be part of your website and linked from your account.
  • Attempt to break, access without authorization, or compromise the security of any computer network or account that does not belong to you.
  • Host proxy server applications or forge/misrepresent headers, addresses or other identification in email or websites.
  • Upload, link to or store warez, cracks or other pirated software, or assist in distributing copyrighted material.
  • Operate server programs such as mail servers, IRC servers, game servers, FTP servers, web servers or streaming servers outside of their intended use.
  • Engage in harassment, denial-of-service attacks, mail bombing, or add addresses to mailing lists without explicit consent.
  • Provide fraudulent payment or account information, or perform a chargeback on any past or present transaction.

17. Grounds for Suspension & Termination

You agree to comply with these Terms and Policies. Any violation of either these Terms and Policies or the other rules, regulations or policies noted above may serve as cause for OgaHost to suspend or terminate your account. You agree that OgaHost has the right, with or without notice, to suspend or terminate your account upon the first or subsequent occurrence of any of the following:

  1. Using the Service in a way which constitutes violation of any applicable statute, law, court order, tariff, regulation, or treaty (including, but not limited to, intellectual property, communications, privacy, criminal and international law).
  2. Hosting websites dedicated to pornography. Legal adult content is allowed however it cannot be the main focus of your website.
  3. Using the Service in a manner intended to abuse or violate the privacy or property rights of others, including but not limited to sending of unsolicited bulk email ("spamming"); you agree to pay a clean-up fee of $30 per hour if any of our server IP addresses appear on a blacklist as a result of spam from your account.
  4. Using your hosting as a file or image hosting service.
  5. Using the Service in an attempt to break security, or so as to actually break security of any computer network (including the Service itself), or to access an account, message, or file which does not belong to you.
  6. Using your account as a backup service. All files must be part of your website and must be linked to from your account. Dedicated server clients are exempt from this.
  7. Using the Service in such a way as to forge or misrepresent headers, addresses, or other identification in electronic mail or websites, or using any other method to disguise the sender's identity or location. This includes the hosting of Proxy Server applications.
  8. Uploading, linking to or storing warez, cracks or other pirated software.
  9. Assisting in or directly distributing copyrighted material.
  10. Excessively using the Service in such a way as to limit the bandwidth available to others.
  11. Providing fake or incomplete contact details, including name, postal address and telephone number.
  12. Using the Service to operate server programs, including, but not limited to mail servers, IRC servers, game servers, FTP servers, web servers, or streaming audio/video servers.
  13. Using the Service for unauthorized relays through any third-party systems.
  14. Attempting, in any way, to interfere with or deny service to any user or any host on the Internet.
  15. Performing a chargeback on any transactions past or present will result in account suspension until resolved. If a chargeback is issued we reserve the right to remove your account and deny any future business.
  16. Using the Service for mail bombing, which includes any instance where multiple messages are sent to a specific destination with the intent to render the recipient and/or the electronic system serving that recipient dysfunctional.
  17. Using the Service to add or attempt to add addresses to any mailing list (yours or a third party's) without the explicit positive consent of the addressee(s).
  18. Attempting to cancel, supersede, or otherwise interfere with email other than your own.
  19. Engaging in harassment, whether through language, frequency, or size of messages, either with email or website content.
  20. Using the Service to engage in syn flood attacks, or any other methods of denial-of-service attacks.
  21. Furnishing false data on your sign-up form, contract, or online application, including providing fraudulent credit card or other payment information.
  22. No bill credit will be given for a period of suspension. In the event of termination of your use of the Service under this section, OgaHost may at its sole discretion retain any or all amounts you have paid for use of the Service as liquidated damages for your actions.
  23. Security – You agree not to access or attempt to access private areas of the Service. You agree to notify OgaHost as soon as you become aware of an unauthorized use of your account and/or any breach or attempted breach of security on the Service.
  24. Intellectual Property – OgaHost does not undertake to examine or review messages, files, or other materials which are accessible through, pass through, or reside on the Service. Complaints regarding alleged copyright infringement can be sent to abuse@ogahost.com.
  25. Liability – You agree that use of the Service is at your own risk. Neither OgaHost nor any of its affiliates controls, provides, operates, or is in any way responsible for any information, products, or services accessible through the Service. OgaHost neither endorses nor is responsible for the accuracy of third-party material(s).
  26. You agree that, should you use the Service to send or receive voice communications, OgaHost is not acting as a telecommunications carrier, and all risk of connection, transmission quality, and accuracy of communications is solely on you.
  27. You agree to be liable for any damages or loss of service which results in damages to OgaHost as a result of any spamming or other violations. OgaHost may pursue any such claims against you in court.
  28. You agree that in no event will OgaHost have financial liability to you.
  29. Warranty – OgaHost MAKES NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, AND WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, REGARDING THE SERVICE.
  30. THE SERVICE AND ANY SOFTWARE PROVIDED TO YOU BY OgaHost ARE PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS; OgaHost DOES NOT WARRANT THAT THEY WILL BE ERROR-FREE AND/OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED. OgaHost DOES NOT GUARANTEE THE SECURITY OR BACK-UP OF ANY OF YOUR DATA.

Termination for Inappropriate Conduct

OgaHost maintains a zero-tolerance policy regarding abusive or inappropriate behavior towards our customer support team. If any client or their representatives engage in disrespectful language, including the use of offensive or inappropriate terms, OgaHost reserves the right to terminate services and close the associated account immediately, without prior notice. In such cases, refund requests and any Service Level Agreement (SLA) commitments will be deemed void and inapplicable. Additionally, OgaHost will not provide data backup or retrieval assistance for terminated accounts.

18. Resource Usage

You may not use 50% or more of system resources for longer than 60 seconds. There are numerous activities that could cause such problems; these include CGI scripts, FTP, PHP, HTTP, etc.

  • Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any BitTorrent application, tracker, or client.
  • Participate in any file-sharing/peer-to-peer activities.
  • Run any gaming servers such as Counter-Strike, Half-Life, Battlefield, etc.
  • Run cron entries with intervals of less than 15 minutes.

You may create your own backup of your account from your control panel; however these may only be stored for up to 7 days. Please download archives to a local source and remove them from your account.

19. Content

You understand and agree that information and access available through the Service may include controversial, sexually explicit, or other material that may be offensive to you or users for whom you are responsible. OgaHost has no responsibility for or control over such materials, and you take sole responsibility for using any available screening software or other methods of limiting access (specifically including the access of minors) to any material you may find objectionable.

20. Privacy

OgaHost will not provide names, addresses, telephone numbers, email addresses, or other personally identifiable information on any Subscriber to any third party without prior permission from that Subscriber, or as required under an appropriate court or administrative directive, including a facially valid subpoena, or as necessary to render the Service. OgaHost may provide aggregate data on Subscribers to third parties in the operation of OgaHost business. See our Privacy Policy for full details.

21. Disputes

You agree that any dispute between you and OgaHost arising out of your use of the Service or in any way based upon your subscription to and/or use of the Service which cannot be resolved between you and OgaHost will be submitted by the aggrieved party for binding resolution under the laws and jurisdiction described in the Governing Law section of this Agreement.

22. Chargebacks

If a customer payment is disputed, charged back, or held by the payment processor, the associated Service will be immediately suspended. A replacement payment of the disputed amount, plus a chargeback fee of not less than $35, must be paid before service can be resumed. In OgaHost's sole determination, one or more chargebacks can be cause for service termination.

23. Cancellation Procedure

Cancellation requests must be submitted through the client area. To do this, click the icon next to the package you wish to cancel then press "Request Cancellation". You must then complete and submit the form.

Choosing an immediate cancellation means your service will be terminated within 24 hours of submitting the form.

It is your responsibility to ensure any PayPal subscriptions you have set up are cancelled.

No other forms of cancellation are accepted.

Cancellations must be submitted before the invoice for that billing cycle is due. Failure to do so will result in the invoice being due. Cancellation requests can only be submitted if the account has no due invoices.

24. Suspended / Terminated / Reactivation Fee

If your Services are suspended or terminated for late payment or non-payment, a reactivation fee of $25.00 per service may be applied to your account at the sole discretion of OgaHost Management. This reactivation fee must be paid in full before the service would be reinstated.

25. Resellers

Resellers may use their website for personal use or to sell to their own clients. Resellers cannot host free accounts under any circumstances.

We will transfer up to a reasonable number of accounts free of charge (as per plan limits). Each account thereafter is charged at a per-account rate depending on account usage.

26. Price Changes

OgaHost reserves the right to change prices for services at the start of a customer's next billing cycle for that service. Due to the historically declining prices of bandwidth and computer hardware, we anticipate that price increases generally will not be necessary. However, events outside of our control, such as prices charged to us for software licenses, power, space, or labor, or due to changes in regulations, taxes, fees, or other costs of doing business, are unpredictable in nature and may at some point require raising rates unexpectedly.

27. Discount Vouchers / Coupons

  • Only one voucher/coupon can be used per transaction.
  • If the order value is lower than the value of the voucher/coupon, the remaining amount is lost.
  • Discount vouchers/coupons are restricted to one per customer.
  • Vouchers/Coupons can be redeemed against the purchase of any Shared, Business or VPS service.

28. Amendments

These Terms and Policies may be amended in any respect at any time by OgaHost upon the posting of the amended Terms and Policies on the terms of use section of the Service. Your continued use of the Service will be deemed consent to any such amended Terms and Policies. If you do not wish to continue to use the Service as a result of any such amended Terms and Policies, you may provide notice of your wish to terminate your use of the Service to OgaHost.

29. Governing Law

These Terms and Policies are governed in all respects by the laws of the United States of America, without regard to its conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in the United States for any dispute arising out of or relating to these Terms or the Services.
